Legal obstacles by appointing Supreme Court Judge to Presidential Commission

There are varying views circulating among the legal fraternity regarding the appointing of Supreme Court Judge Vijith Malalgoda to the committee appointed by the President to investigate the Easter Sunday bombings.

Meanwhile, expressing his views to the Ravaya newspaper, a legal expert has stated that under paragraph 110 of the Constitution, the President could only summon Supreme Court and Appeals Court judges for appropriate duties under the written law.

Legal expert Dr. Nihal Jayawickrama has said that although the President has the ability to appoint them to a presidential commission or special commission, any other position should not be accepted. This, he said is stated in the Constitution.

He has said it is questionable that if the Chief Justice had given permission, under which legal provision he did so.
